color:#222222"> 30 กรกฎาคม 2556 ในวาระการประชุมสมัชชาใหญ่ขององค์การสหประชาชาติ ณ กรุงนิวยอร์กในเดือนกันยายนนี้ เลขาธิการองค์การสหประชาชาติได้เชื้อเชิญให้รัฐสมาชิกร่วมการลงนามในอนุสัญญาฉบับต่าง ๆ ซึ่งการประชุมนี้เรียกกันว่า UN Treat Event สมาคมเพื่อการต่อต้านการทรมาน (The Association for the Prevention of Torture- APT) สนับสนุนให้ประเทศไทยใช้โอกาสดังกล่าวในการยืนยันคำมั่นว่าจะป้องกันการทรมานและการปฏิบัติอย่างโหดร้ายโดยการลงนามในพิธีสารเลือกรับของอนุสัญญาป้องกันการทรมาน (OPCAT)
color:#222222">การลงนามในอนุสัญญาป้องกันการทรมานในงาน Treaty Event สิ่งนี้จะเป็นก้าวย่างที่สำคัญสำหรับประเทศไทยที่จะเพื่อแสดงถึงความมุ่งมั่นของประเทศไทยในการป้องกันการทรมานและการปฏิบัติอย่างโหดร้ายก่อนการเยือนประเทศไทยอย่างเป็นทางการของผู้แทนพิเศษขององค์การสหประชาชาติด้านการทรมานในเดือนกุมภาพันธ์ ปี 2557 และการนำเสนอรายงานประเทศต่อคณะกรรมการขององค์การสหประชาติว่าด้วยการต่อต้านการทรมานในปีพ.ศ. 2557 ที่จะถึงนี้
การลงนามในพิธีสารเลือกรับของอนุสัญญาต่อต้านการทรมานนั้นแสดงหมายถึงรัฐสมาชิกเห็นด้วยที่จะให้มีการตรวจเยี่ยมสถานที่ควบคุมตัวทั้งในเรือนจำและสถานีตำรวจโดยผู้เชี่ยวชาญที่เป็นอิสระอย่างสม่ำเสมอ ซึ่งจะกลไกในการป้องกันการทรมาน ปัจจุบันพิธีสารเลือกรับฉบับนี้มีรัฐสมาชิกแล้วทั้งสิ้น 70 ประเทศทั่วโลกที่ริเริ่มดำเนินการกลไกป้องกันการทรมานนี้ร่วมกัน
สมาคมเพื่อการต่อต้านการทรมาน ขอแสดงความยินดีที่ประเทศไทยได้พัฒนาให้มีการป้องกันการทรมานและการปฎิบัติอย่างโหดร้ายในหลายปีที่ผ่านมา โดยเฉพาะอย่างยิ่งร่างแก้ไขกฎหมายอาญาที่จัดให้มีข้อหาการทรมาน และจะจัดให้มีการศึกษาหาความเป็นไปได้ในการเข้าเป็นรัฐภาคีในพิธีสารเลือกรับอนุสัญญาต่อต้านการทรมาน อีกทั้งกระทรวงยุติธรรมได้จัดให้มีการปรึกษาหารือกับตัวแทนของหน่วยงานรัฐภาคส่วนต่างๆ ไปแล้ว
ในจดหมายที่ทางสมาคมเพื่อการต่อต้านการทรมานส่งถึงผู้แทนถาวรไทยประจำองค์การสหประชาชาติ ณ นครนิวยอร์กนั้น เราได้ขอให้ประเทศไทยใช้โอกาสในงาน UN Treaty Event ณ นครนิวยอร์กในระหว่างวันที่ 24-26 กันยายน และวันที่ 30 กันยายนถึง 1 ตุลาคม 2556 ลงนามในพิธีสารเลือกรับอนุสัญญาว่าด้วยการต่อต้านการทรมาน
Time for Thailand to ratify UN’s torture prevention treaty
GENEVA 30 JULY 2013. In September, at the opening of the General Assembly in New York, the Secretary General of the United Nations invites Governments to participate in the yearly treaty ratification signature ceremony, known as the UN Treaty Event. The Association for the Prevention of Torture (APT) encourages Thailand to seize this opportunity to confirm its commitments to prevent torture and ill-treatment and to ratify the Optional Protocol to the UN Convention against Torture (OPCAT).
It would be a significant step for Thailand to ratify the OPCAT during the UN Treaty Event, to express Thailand’s commitment to preventing torture and ill treatment ahead of the Special Rapporteur on Torture’s visit to Thailand in February 2014 and the State review before the UN Committee against Torture in May 2014.
By ratifying the OPCAT, States agree to open up prisons, police cells and all other places of detention to independent monitoring by expert bodies, as a way to prevent abuse. Some 70 States from around the world have already joined this new system.
The APT welcomes the positive developments to prevent torture and ill-treatment in Thailand in recent years, in particular the on-going work to reform the criminal code to include the offence of torture, and the recent commitment to study the possibility of OPCAT ratification. The Ministry of Justice, Rights and Liberty has already started consultations with concerned government agencies.
In a letter sent to the Permanent Mission of Thailand to the United Nations in New York, we now encourage Thailand to seize the opportunity of the UN Treaty Event in New York (24-26 September and 30 September – 1 October 2013), to take the next step and to ratify the OPCAT.
