ศาลจังหวัดยะลาเชื่อว่านายอัสฮารี สะมาแอ เสียชีวิต
ในระหว่างถูกควบคุมตัว เนื่องจากถูกเจ้าหน้าที่ทำร้ายร่างกาย
เมื่อวันที่ 28 มิถุนายน เวลา 2555 09.00 น. ศาลจังหวัดยะลา ได้อ่านคำสั่งคดีไต่สวนชันสูตรพลิกศพนายอัสฮารี สะมะแอ ในคดีหมายเลขดำที่ ช.13/2552 ว่า ศาลได้พิเคราะห์พยานหลักฐานว่า นายอัสฮารี สะมะแอ ถูกจับกุมและควบคุมตัวโดยเจ้าหน้าที่ทหารและตำรวจ และถูกทำร้ายร่างกายจนเป็นเหตุให้ได้รับบาดเจ็บสาหัส สมองช้ำ และต่อมาเสียชีวิตที่โรงพยาบาลศูนย์ยะลา เนื่องจากประจักษ์พยานยืนยันว่าตนเองถูกทำร้ายร่างกายพร้อมนายอัสฮารี จนได้รับบาดเจ็บ คำเบิกความดังกล่าว สอดคล้องกับมีใบรับรองแพทย์ของโรงพยาบาลค่ายอิงคยุทธบริหาร และสภาพบาดแผลตามร่างกายของนายอัสฮารี จึงเชื่อได้ว่านายอัสฮารีเสียชีวิตในระหว่างควบคุมตัวเนื่องจากถูกเจ้าหน้าที่ทำร้ายร่างกาย
ภายหลังจากศาลมีคำสั่งไต่สวนชันสูตรพลิกศพแล้ว ศาลให้ส่งสำนวนไต่สวนดังกล่าวไปยังพนักงานอัยการเพื่อพิจารณาดำเนินการเกี่ยวกับคดีอาญาต่อไป
เหตุคดีนี้เมื่อวันที่ 21 กรกฎาคม 2550 ระหว่างการควบคุมตัวนั้นนายอัสฮารีและเพื่อนได้ถูกเจ้าหน้าที่ทหารหน่วยเฉพาะกิจที่ 1 หน่วยเฉพาะกิจที่ 13 จังหวัดยะลา ร่วมกับเจ้าหน้าที่ตำรวจสภ.ปะแต อ.ยะหา จ.ยะลา ได้อาศัยอำนาจตามกฎอัยการศึก ทำร้ายร่างกายในระหว่างการจับกุมและควบคุมตัว จนได้รับบาดเจ็บสาหัส และทำให้นายอัสฮารีเสียชีวิต ในเวลารุ่งเช้าของวันที่ 22 กรกฎาคม 2550 ที่โรงพยาบาลศูนย์ยะลา

Provincial Court of Yala rule that Mr. Asharee Samaae’s death was caused by
state officers during his being held in custody
On 28 June 2012, 09.00 am, the Provincial Court of Yala read out a verdict on a post mortem inquest trial on the death of Mr. Asharee Samaae in Black Case no. Chor13/2552. Reviewing evidence, the Court believes that Mr. Asharee Samaae was arrested and held in custody by military and police officers and during the time, he was subjected to deadly physical assault causing grave injuries including brain contusion. He died at the Yala Central Hospital. Eye witnesses in this case included those being physically abused together with the deceased and the testimonies were consistent to a report of physical examination by medical doctors from the Ingkhayudh Borihan Army Camp including information concerning bodily wounds found. Thus, it is believed by the Court that Mr. Asharee Samaae died during his being held in custody and he died of being physically abused by the officers.
After the verdict on inquest trial was read out, the order shall be submitted to the public prosecutors who will decide whether or not to pursue a criminal prosecution against the perpetrators.
The incidence of the case took place on 21 July 2007, while Mr. Asharee Samaae and other friends were held in custody by military officers at Taskforce 1 and 13 of Yala province and police officers from Patae Police Station, Yaha District, Yala invoking martial law. He was physically abused while being held in custody and suffered grave physical injuries and later died in the morning of 22 July 2007 at the Yala Central Hospital.
