ไต่สวนญาติผู้เสียชีวิต 4 ศพ ต.ปุโละปุโย อ.หนองจิก จ.ปัตตานี

 

เมื่อวันที่ 10,11 พ.ย. 2555  ศาลจังหวัดปัตตานี  นัดไต่สวนพยานฝ่ายพนักงานอัยการผู้ร้องขอไต่สวนชันสูตรพลิกศพ ตามม. 150 ป.วิฯอาญา ในคดีหมายเลขดำที่ ช.5/2555  ผู้เสียชีวิตในคดีนี้  คือ นายอิสมัน ดือราแม กับพวกรวม 4 คน ซึ่งเสียชีวิตเนื่องจากถูกทหารพรานยิงเสียชีวิต เหตุเกิดเมื่อวันที่ 29 มกราคม 2555 บ้านหมู่ที่ 1 ต.ปุโละปุโย อ.หนองจิก จ.ปัตตานี

 

การไต่สวนดังกล่าวเป็นวันไต่สวนนัดแรก  พนักงานอัยการได้นำพยานเข้าไต่สวนทั้งหมด  3 คน คือ นางมีเนาะ ลาเตะ  นางลีเยาะ  สามาแอ  และนายหามะ บือราเฮง  ซึ่งเป็นญาติของผู้เสียชีวิต  และขอเลื่อนคดีไปไต่สวนพยานพนักงานอัยการผู้ร้องเพิ่มเติมอีกในวันที่ 23 ธ.ค. 2555 และ 19-20 ม.ค. 2556

 

ทั้งนี้  พนักงานอัยการออกหมายเรียกพยานเจ้าหน้าที่ทหารตำรวจที่เกี่ยวข้องกับเหตุการณ์มาเบิกความที่ศาลตามวันนัดดังกล่าว  แต่เจ้าหน้าที่ดังกล่าวมีหนังสือแจ้งว่าไม่สามารถมาเบิกความที่ศาลได้  อีกทั้งพนักงานอัยการได้แถลงต่อศาลว่าจะขอเพิ่มพยานบุคคลซึ่งเป็นญาติผู้เสียชีวิต 4 คน  ซึ่งเดิมพนักงานอัยการไม่ได้อ้างญาติผู้เสียชีวิตเป็นพยานแต่อย่างใด  และเนื่องจากญาติผู้เสียชีวิตก็ได้มาศาลในวันนัดไต่สวนด้วย  ศาลจึงให้พนักงานอัยการนำพยานซึ่งเป็นญาติผู้เสียชีวิตเข้าเบิกความทันที      โดยพนักงานอัยการได้ยื่นคำร้องขอระบุพยานเพิ่มเติม    และนำนายหามะ

 

 บือราเฮง  บิดานายรอปา  บือราเฮง  ผู้ตายที่ 4  เข้าเบิกความในวันที่ 10 พ.ย. 2555 และนำนาง    มีเนาะ ลาเตะ ภรรยานายสาหะ  สาแอ  ผู้ตายที่ 2 และนางลีเยาะ  สามาแอ  ภรรยานาย   หามะ   สะหนิ  ผู้ตายที่ 3  เข้าเบิกความในวันที่ 11 พ.ย.2555 แทนญาติผู้ตายทั้งสามได้เบิกความไปในแนวทางเดียวกันว่า วันที่ 29 ม.ค. 2555 เวลาประมาณ 20.30 น.  ผู้ตายทั้งสี่และบุคคลอื่นรวม 9 คน ได้เดินทางโดยรถยนต์กระบะคันเกิดเหตุออกไปละหมาดศพที่บ้านทุ่งโพธิ์ ซึ่งอยู่ไม่ไกลจากหมู่บ้านของผู้ตายทั้งสี่  หลังจากกลุ่มผู้ตายออกจากหมู่บ้านไม่นานก็ได้ยินเสียงปืนดังรัวติดต่อกันเป็นเวลานาน และเห็นผู้บาดเจ็บวิ่งกลับมาที่หมู่บ้าน  จนกระทั่งเวลาประมาณเที่ยงคืนได้มีผู้ช่วยผู้ใหญ่บ้านไปรับญาติผู้ตายไปดูศพที่โรงพยาบาลหนองจิก

 

            สำหรับเหตุของคดีนี้ เจ้าหน้าที่ทหารพราน กองร้อยทหารพรานที่ 4302 บ้านน้ำดำ ต.ปุโละปุโย อ.หนองจิก จ.ปัตตานี อ้างว่าได้นำกำลังติดตามคนร้าย และตั้งจุดสกัดกั้นบริเวณทางเบี่ยงจากถนนสี่เลนส์  เข้าบ้านหมู่ที่ 1 ตำบลปุโละปุโย พบรถยนต์กระบะของชาวบ้าน เจ้าหน้าที่ทหารพรานได้สกัดกั้นรถคันดังกล่าว และได้ยิงปืนเข้าใส่ จนเป็นเหตุให้ชาวบ้านเสียชีวิต  4  ราย และ ชาวบ้านรับบาดเจ็บอีก 5  ราย

 

เมื่อวันที่ 20  เม.ย.  2555 พนักงานอัยการจังหวัดปัตตานีผู้ร้อง  ได้ยื่นคำร้องขอไต่สวนชันสูตรพลิกศพ ผู้ตายทั้งสี่  เพื่อให้ศาลทำการไต่สวนและทำคำสั่งว่าผู้ตายคือใคร  ตายที่ไหน เหตุและพฤติการณ์ที่ตาย  ม. 150 ป.วิฯอาญา  เนื่องจากเป็นความตายที่เกิดขึ้นโดยการกระทำของเจ้าพนักงานซึ่งอ้างว่าปฏิบัติราชการตามหน้าที่  และญาติของผู้ตายทั้งสี่ได้ยื่นคำร้องขอเข้าเป็นผู้ร้องคัดค้าน โดยมีนายนิลี  ดือราแม บุตรชายนายอิสมัน ดือราแม เป็นผู้ร้องคัดค้านที่ 1 นางมีเนาะ     ลาเตะ ภรรยานายสาหะ สาแม เป็นผู้ร้องคัดค้านที่ 2 นางลีเยาะ สามาแอ ภรรยานายหามะ สะหนิ เป็นผู้ร้องคัดค้านที่ 3 และนายหามะ บือราเฮง บิดานายรอปา บือราเฮง เป็นผู้ร้องคัดค้านที่ 4 โดยแต่งตั้งทนายความเข้าซักถามพยานของพนักงานอัยการผู้ร้องและนำเสนอพยานหลักฐานเพิ่มเติมในทางไต่สวนต่อศาลด้วย

Post Mortem Inquest of Four Deaths in Tambon Pulopuyo, Nongchik District, Pattani
 
During 10 and 11 November 2012, the Provincial Court of Pattani conducted post mortem hearings as proposed by the public prosecutors and required by Section 150 of the Criminal Procedure Code in the Black Case no. Chor5/2555. The victims in this case including Mr. Isman Duramae were gunned down by military rangers on 29 January 2012 at Moo 1, Tambon Pulopuyo, Nongchik District, Pattani.
 
During the first hearing, three witnesses were introduced by the public prosecutors for examination including Mrs. Menao Latae, Mrs. Liyoh Sama-ae and Mr. Hama Buraheng, relatives of the deceased. More examinations of the prosecution witnesses were requested and shall take place on 23 December 2012 and 19-20 January 2013. 
 
Prior to the first hearing, military and police officers involved with the incidence had been asked to testify in the Court, but they informed the public prosecutors by letter that they could not come on the proposed dates. In addition, the public prosecutors proposed to the Court for have four more witnesses who are relatives of the deceased examined. Previously, the public prosecutors had not proposed to have them included. But since the relatives of the deceased were present during the hearing, the Court asked them to give their testimonies right away. 
 
In the list of additional witnesses proposed by the public prosecutors are Mr. Hama Buraheng, father of Mr. Ropa Buraheng, the fourth deceased, to testify on 10 November 2012, Mrs. Menao Latae, wife of Mr. Saha Sa-ae, the second deceased and Mrs. Liyoh Sama-ae, wife of Mr. Hama Sani, the third deceased to testify on 11 November 2012. The three witnesses gave a congruent account that on 29 January 2012, around 20.30, the four deceased and others, altogether nine of them, drove a pickup truck to attend a funeral service at Ban Thung Poh, not far from their village. After leaving their village for a while, a series of gunshots were heard for quite a long time, and injured persons ran back to the village. Around midnight, the Deputy Village Headman helped to bring the relatives to retrieve the bodies of the deceased from the Nongchik Hospital. 
 
According to the rangers at the Ranger Company 4302 Ban Namdam, Tambon Pulopuyo, Nongchik District, Pattani, on that day, they were mobilizing forces to follow some perpetrators who appeared to have entered Moo 1 in Tambon Pulopuyo. A checkpoint was set up on a local road off the four-lane highway, an entrance into Moo 1 Tambon Pulopuyo. Upon seeing the pickup truck, the officers stopped the car and shot into the vehicle killing four villagers and injuring other five villagers. 
 
On 20 April 2012, the Pattani public prosecutors, as petitioner in this case, requested the Court to conduct a post mortem hearing in order to identify as to who the deceased are, where and how they died as required by Section 150 of the Criminal Procedure Code since the deaths could have been caused by an act of the officers who claimed to have executed their official duties. Relatives of the four deceased has also submitted their counter-argument to the claim including Mr. Nili Duramae, son of Mr. Isman Duramae, as the first objector, Mrs. Menao Latae, wife of Mr. Saha Sa-mae, as the second objector, Mrs. Liyoh Sama-ae, wife of Mr. Hama Sani, as the third objector and Mr. Hama Buraheng, father of Mr. Ropa Buraheng, as the fourth objector.  Legal representatives have been appointed to conduct examination and to propose additional evidence to the Court.
